Humboldt Decision Delayed

The MDEQ asked for a third delay this year on making a decision on the proposed Kennecott Eagle Minerals Company reuse of the Humboldt Mill. In June, the DEQ asked the deadline to be extended to allow the agency to review and evaluate Kennecott’s response to the requests for clarification submitted to the Department from Kennecott earlier this year. Ruling on jurisdiction not in favor of petitioners

The National Wildlife Federation, Keweenaw Bay Indian Community, Huron Mountain Club, and Yellow Dog Watershed Preserve have pointed out that the DNR’s land lease decision violated the common law public trust doctrine. The plaintiffs asked that Judge Paula Manderfield should consider that re-opening a previous decion.
